I would not suggest that pretty well any litigation was a "slam dunk", but I did find some aspects of this case comment puzzling.

Prof. Weinrib seems to suggest, in the final paragraph, that "polyamorous relationships entered into consensually by fully informed adults able to end the arrangements at any time" are not legally problematic, or at least may not be so. If this is true, does it not follow that the complete prohibition of polygamy is overbroad? If there are problems with issues of consent etc., would this not be dealt with more appropriately by legislation that specifically targetted that harm (supposing there are not Criminal Code provisions already that would serve this purpose)? As far as I can see, if the law is overbroad, it should be struck down, even if in this particular case there may be some harm. If so, the problem would be that the wrong charges were laid.

A somewhat different point is that Prof. Weinrib seems to see harm in closed heirarchical communities. I see some force to this, but there are many such communities that do not involve polygamy. If this kind of harm is severe enough for the state to intervene, then should it not intervene even more broadly, whether or not polygamy is an issue?
